Couple win stay on €5.1 million judgement

A couple who claimed a bank breached the Central Bank’s code of conduct on mortgage arrears in pursuing €5.1 million judgment orders against them with a view to repossessing their home over mortgage arrears have secured a High Court stay on the bank’s action.

The president of the High Court, Mr Justice Nicholas Kearns, granted the stay to John and Joan Nagle, of Falmore, Falls Road, Shankill.

Earlier, counsel for the couple said they had sought the appeal after the bank’s rejection of repayment proposals advanced in May last year.
